Can I leave the state with my son???? Please help! [Revised Subject added by

I'm 18 years old and met my 25 year old husband a year ago. I lived in SC, he lived in GA. We got married six months after finding out I was pregnant. I moved to Georgia right after the wedding. My son is now four months old and things have turned sour. Husband has a terrible temper, is horrible with our money, smokes (which he agreed to stop before the wedding and never has). He gets really angry for no reason and throws things in the home. When my son was a month old he threw a glass plate against the wall, shattered, and some glass almost hit our son. I called 911 but hung up. The police came. They didn't make a report, just talked to us. I have to say husband is NOT physically abusive, but is verbally abusive and does have a terrible temper which causes him to act out and throw things around in the house about once a month. I want to go back home to SC. There is no family here or friends that I can stay with. I would like a legal separation, following with a divorce down the line. The cops said that they couldn't prevent me from leaving with him the time that they came when he was a month old. Is this true? I want to move back home but I can't afford a lawyer, I'm a stay-at-home mom! I want him to be able to see his son, but I can't continue to live like this. When the cop said he couldn't prevent me from leaving...did he just say that because he thought I would be coming back? Or is it really true that I can move back home? I was there most of my pregnancy and HE came to ME...I never wanted to move here.

Check legal and jurisdiction statute in your COUNTY! Keep a daily log of every occurance. It WILL help you in the future. Be sure you don't have any shadows of your own.

RUN GIRL! My ex was also verbally and emotionaly abusive, was beginning to get physical when I left. He in return has used the children to continuie this thru the good courts of our nation. If he is abusive ,he has to have controll and it will not stop. Go to court as soon as possible, document outrages, get witness, help you and your child now, things will happen that you will not expect or believe. He who files first pretty much gets thing the way they
want, no matter the truth. good luck. (Last changed: February 26, 2006)
